looking at the crane and the site of that accident. authorities say that two bodies have been recovered from the wreckage of a small airplane that went down in contra costa county yesterday. officials said it appeared just one person was killed in that firey crash at 2:00 p.m. yesterday. the coroners office has not yet released the names of the victims. according to the faa records the experimental plane was owned by a novato man. >> mountain view police are investigating a rare crime along the stevens creek trail. a man told police he was on the trail last week when someone came up from behind and tried to take his backpack out of his hand. that was about 8:00 in the evening. the man described the would-be robber as latino. ten inches tall with a medium build. >> i have the same fear every morning because it is dark. i fear someone will come out and attack me because you can't see where they are coming from. >> police say you need to be aware of your surroundings. if you are walking on that

trail. a former san jose police officer is suing the city said he suffered retaliation after telling his superiors about rampant time cards within the city. we are live in san jose with what the officer says others were doing while on the clock. >> reporter: like many of us san jose police have to fill out time cards to show the hours they work and now retired officer who was assigned here to the san jose airport is alleging time card fraud in the department is wide spread. 27 veteran filed this lawsuit this week in federal court. he alleges he was retaliated against labeled a snitch and eventually forced to retire. for reporting fellow officers charging for hours they did not work. >> the retaliation you do something you are a target.

>> san jose police would not discuss the lawsuit but did address the broader issue of time card fraud. >> we have to make sure we are clean. we police ourselves aggressively and have measures in place to make sure that happens. >> reporter: just last week following a nine month investigation san jose police arrested one of their own. officer jeffrey inslin for felony grand theft. he is charged with time card fraud. >> that is the message to the community, if we find this activity we are not going to cover it up. >> reporter: the assistant city attorney who handles lawsuits tells me there is nothing contained in the current complaint that is new and she will aggressively defiend the city. reporting live in san jose rita williams. some very smart thieves

have stolen personal banking information from thousands of people who shopped at barnes and noble bookstores and several are here in the bay area. specifically in cover tama terra. san bruno. san jose, san mateo and walnut creek. mike mibach is in walnut creek. >> reporter: you talk about smart thieves. one law enforcement source telling me barnes and noble was targeted by a very sophisticated group. all stores were hit. thousands of customers possibly even more have their private banking information all swiped away with one swipe of the card. downtown walnut creek 1149 south main street. >> every once in awhile i will stop by and pick something up. >> reporter: barnes and noble a hot spot for many book enthusiast. >> it's something about browsing through books on a book shelf. >> reporter: it has ban hot

spot for many sophisticated criminals. those pin pads were compromised within dozens of stores across nine states. a spokeswoman for the company said the criminals planted bugs in the tampered pin pad devices allowing for the capture of credit card and pin numbers. >> it's never safe. not even online. >> i feel pretty safe swiping my card. >> reporter: any concern about the security of your account information when you slide that? >> maybe should have, but that's the way the modern world is. >> reporter: the fbi in new york is the lead investigative agency because that is where the largest book seller is headquartered. spokes women for the company declined to give a timeline on when the bugs were planted or how long they had been in use. >> we still have an investigation on this. we're trying to maintain the integrity of our investigation. >> reporter: meantime customers say cash is safe, cards are not. >> even in retail stores i use cash most of the time.

>> reporter: barnes and noble says its pin pads were removed from all of the stores. it says barnes and noble.com and nook devices and app was not effected. the fbi is looking at all possibilities as to who is responsible for this data bridge from an inside job to possibly an international crime ring. reporting live in walnut creek mike mibach. the federal government filed a lawsuit today against bank of america over an alleged mortgage scheme. they are accusing the bank of selling thousands of toxic home loans to fannie mae and freddie mac because of a scheme to speed up the loan process. the so-called hustle was in orientation at country wide financial when b of a bought that lender back in 2008. the lawsuit claims it resulted in thousands of foreclosures and $1 billion in losses. google android operating system could beat out microsoft

windows within four years. this would be a huge shift in technology. its research shows at the end of 2016, 2.3 billion computers and tablets will be using google software. it's believed the shark that killed a surfer in santa barber county was a great white shark. he was bitten in the upper torso at surf beach in long pock. that beach is now closed. it's the same place another surfer was killed by a shark two years ago. the experts say the shark was probably about 15 feet long and may have mistaken the surfer for a seal. here's a live picture we are showing to you for the first time. giants fans are filing into at & t park right now. ureases than an hour away for the first pitch of the game one of the world series. just a few leftover showers. coming up i'll let you know when the showers will move out

suspect is is behind bars in the brutal killing of young sacramento mother and her two toddlers. he is being held without bail on three charges of murder. he is the brother of a man from rancho cover doe slow who came home to find his wife, two-year- old son and three-year-old son all dead. the victims appear to have been stabbed to death. the couples six-month-old baby was found unharmed. the san jose city council stands on a proposed minimum wage hike is no position. the council voted to opposed

costa county. the worst case scenario the fire chief there said he's trying to prevent. a noticeably missing name from a port of oakland receipt is at the center of more questions tonight. last week the ports executive director omar benjamin was placed on paid administrative leave after a ktvu investigation revealed public money was spent by port executive james quan at a texas strip club. port officials redacted benjamin's name from the treasures gentleman's club receipt. sources tell ktvu benjamin was definitely with quan at the strip club. tomorrow night on the 10:00 news we continue our investigation into the port's expenses and reveal it was not just quan who spent public money at questionable places right here in the bay area. in san francisco a homeless man who was sleeping in someone's driveway was run over and killed. happened about 7:00 a.m. yesterday on third street in the south of market area. police say a woman backed over

the man as she was pulling out of her garage. they haven't disclosed other details about the incident expect to 51 the man was 60 years old. san francisco's massive one stop homeless services program is expanding. ktvu rob ross spent the day talking with homeless people about the new plan to provide special service seven days a week. >> reporter: here inside the bill graham civic auditorium more than 1,000 people came for help from dental problems. to aching feet. and most everything between. the city ran services called project homeless connect and operates one day every other month thanks to an army of volunteers but city leaders announce today the program is expanding to every day beginning monday. >> unemployment run out and here i am. >> reporter: timothy is a vietnam veteran who lost his home and staying in a shelter. >> housing is the main thing

what i need. and that and for other people around here there is a will, there is a way to get it now. if they are expanding the services, i think it's great. >> reporter: the every day program was supposed to launch two years ago but because of the budget crunch it went on the back burner until now. the daily program will run on a smaller scale. whatever a homeless person may need such as new clothes for a job interview, the program will try to provide. >> we can serve people who may not feel comfortable coming into this crowded of an event. >> reporter: under the program a homeless person will have an individual caseworker and the city is asking volunteers to post any services they can offer on facebook or twitter. >> a lot of times our circumstances are not of our own making. and we're doing our best to get through them and get to the other side. >> reporter: in san francisco

rob ross. the showers we've been watching all day long beginning to move out of the bay area. right now a few lingering clouds. there isn't a slight chance of a left over sprinkle. right now the maps on live storm tracker 2 you can see the coverage with the cloud cover and also the radar not a lot to show you on the radar as we come take a look at a closer inspection here and a little bit of activity most of this not really reaching the ground. here of course we are watching san francisco closely. we will fly across the bay back into san francisco and not much in the way of radar activity right now. in fact, we do have partly cloudy skies at the ballpark. the world series exciting to say game one and first pitch just after the 5:00 hour. partly cloudy skies. winds out of the west around 12 miles an hour. and temperatures are pretty chilly. they will continue to drop back down into the upper 50s. current numbers are in the 60s out there. santa rosa checking in 63.

when i see that our schools are 47th in spending per student, i just can't accept that. our schools shouldn't be 47th in anything. proposition 38 bypasses sacramento, and makes education a real priority- with the funding, to our local schools and the accountability from our local schools...

>> contra costa county fire chief is trying to rally support for measure q to keep fire stations from closing. chief darrell says the district has already cut everywhere it can and used up $25 million in reserves. and to prevent the closure of as many as ten fire stations over the next two years he says the district needs voter approval for a $75 a year parcel tax. he says without that money, the district will have to implement a service reduction plan. >> we don't meet the standard currently and so when you start to look at reducing that capacity by 30% potentially, it has a huge impact on our ability to respond in a timely manner and be able to protect the community. >> opponents have a different view. the district has been living beyond its means and should come with a long-term plan that addresses the spending issues. we are minutes away from the first pitch of game one of the worlds series. ktvu joe phon city is live at

at & t park where there is a lot of talk about each team's starting pitcher. >> reporter: you know it has been great for a couple of weeks but there is a little different vibe out here tonight. oftentimes pitching is what determines winning and losers in the post season. those that figure detroit might win the series is because of justin verlander. they believe he can go in games one, four, and seven he was dominant as the tigers defeated the a's. now find me the person back in april who said barry zito would be starting game one of the world series for the giants. but to a man after a clinching game on monday, the players pretty much cite zito and that effort he had in st. louis in game five of giving them the spring board to be here. his season cap pew lates what they have been like all yearlong. >> this team has had their tests in the regular season and the tests we encounter in the
